Robbery is a type of charge that has a wide range of severity and sentencing depending upon the circumstances of the alleged crime committed. Robbery is defined as taking another person’s property by force. For example, placing something in one’s pocket and walking out of a store is theft. However, holding a person at gunpoint and demanding their purse, wallet, or car is robbery under Texas law.

Texas Legal Definition of Robbery

Robbery can be charged as a 2nd degree felony if, during the course of the theft, an individual:

  • Intentionally, carelessly, or knowingly causes physical injury to another person.
  • Intentionally or knowingly threatens another person with physical injury or death.
  • Intentionally or knowingly places another person in fear of physical injury or death.

Robbery can be charged as a 1st degree felony (Aggravated Robbery) if, during the course of the theft, an individual:

  • Causes serious physical injury to another person.
  • Uses or shows/brandishes a deadly weapon.
  • Threatens with or places a person in fear of bodily injury or death when that person is over 65 or disabled.

Penalties for Robbery Crimes

Robbery (2nd Degree Felony)

  • Up to $10,000 fine
  • Minimum 2 years in prison (MANDATORY)
  • Maximum 20 years in prison
  • Up to 10 years probation if eligible

Aggravated Robbery (1st Degree Felony)

  • A deadly weapon is used or displayed during the Robbery
  • Up to $10,000 fine
  • Minimum 5 years in prison
  • Maximum 99 years or life in prison
  • Up to 10 years probation in some cases
